As Japanese companies deepen their footprint across Southeast Asia, India, and beyond, particularly in energy, infrastructure, construction and resources, the regulatory environment is shifting under them. Tariff changes, licence revocations, shifting energy-transition policy, and creeping expropriation can erode the value of investments that took years to build. Investment treaties, and the investor-State dispute resolution (ISDS) mechanism that enforces them, remain one of the most powerful and underused tools available to protect those investments.
This seminar offers a clear, practitioner-led briefing on how Japanese outbound investors can use the network of treaties available to them, including the CPTPP, RCEP, the Japan-EU EPA, and Japan's bilateral investment treaties, to manage political and regulatory risk before disputes arise, and to pursue protection when they do.
