As AI use permeates into ordinary business functions, it is becoming a question of board oversight rather than a technology procurement decision. In most organizations, employees are already using publicly available AI tools with company data, frequently without authorization. Confidential information leaves organizations through prompts, and records accumulate on servers the organization does not control, long before any policy has been adopted. The question is no longer whether to allow AI, but whether and how you can govern it — and for Asia-based groups the exposure arrives through multiple lenses at once: confidentiality, data protection, intellectual property, regulation, accuracy and operational risk, reputation, and third-party dependency. A cross-border footprint multiplies each of them.
Part I — The Boardroom
- The four pillars of a governance programme that works in practice, and why the policies that change behavior look quite different from the ones that merely exist.
- Where the real distinctions between AI tools lie — not in capability, but in the handful of attributes that determine your exposure — and the vendor and contract terms that quietly decide the outcome of most later disputes.
- What credible board oversight looks like when it is examined afterwards, and how a regional group builds compliance once across the EU, US, Japanese and Singaporean regimes rather than four times over.
Part II — The Courtroom
- How the use of AI can put privilege at risk, when AI-assisted work is protected and when it is not, and which of your documents are discoverable the moment they are created.
- What a dispute reaches first: the logs, the retention settings and the vendor arrangements — and the preservation failures that have already drawn serious sanctions.
- What courts, regulators and arbitral tribunals now expect of parties and their counsel, and how robust internal controls translate into a concrete advantage when a claim lands.
